Jaiku's hosted in Finland, so a DMCA takedown notice (should one appear) would have little relevance I believe (IANAL, etc).
I have no idea what official stance Jaiku will have, but I'm hopeful that it will be pretty much the same as my personal one :)
I stopped visiting digg but not because of this. The users are whiny, entitled, pre-pubescent know-it-alls and just really get on my nerves. Same reason that I stopped reading comments on Slashdot many moons ago.
It's not just an "I don't like the MPAA" movement of civil disobediance. The group trying to "protect" their intelectual property or to more rightly call it, their trade secret, included the code in their C&D letter and their court filing because it's part of one of the offending URL's in the complaint.
